Bal de Triomphe Raffle Raffle Rules and Regulations Cincinnati Opera 2022

  1. General. By participating in the “Bal de Triomphe Raffle” (the “Raffle”), entrants agree to be bound by these “Official Rules” and by the decisions of Cincinnati Opera which shall be binding and final as to all matters related to the Raffle. The Raffle is subject to all applicable federal, state, and local laws and is void where prohibited.
  2. The Raffle Period. The Raffle will run from May 5th, 2022 6:00PM ET to June 25th, 2022 11:59PM ET.
  3. The Prize. The Viking European River Cruise is valid for one Standard Stateroom up to Category E, double occupancy, cruise only. Cruise includes an 8-day European river cruise, included meals, shore excursions and tours. Airfare, transfers, land extensions and cruisetours are not included. Not transferrable; no credit will be issued for cruise fares of lesser value; value may not be exchanged for cash. Valued up to $6,998. Valid on available 2022 or 2023 embarkations only. Blackout dates may apply. Not combinable with any other offer or Future Cruise Voucher. Subject to stateroom availability. Must make reservations within 120 days prior to departure. Additional add-ons, such as air, transfers, hotels, etc. are only payable by credit card. Restrictions may apply.
  4. Charitable Proceeds. All proceeds from the Raffle Tickets will benefit Cincinnati Opera, an Ohio, non-profit corporation, and the charitable programs and services Cincinnati Opera provides.
  5. The Raffle is open to all persons age eighteen (18) and older unless such a person is located in a territory that prohibits or otherwise limits participation in charitable raffle events at the time of purchase of a Raffle Ticket.
  6. Purchasing Raffle Tickets. All Raffle Tickets may be purchased as follows: one (1) Raffle Ticket for $150.00 USD. There are no discounts or complimentary Raffle Tickets available. Tickets can only be purchased at designated Cincinnati Opera events and/or through a designated Cincinnati Opera representative. There is no limit to the number of raffle tickets an entrant can purchase. Each entrant will receive a receipt in the form of a portion of the Raffle Ticket(s) corresponding to his/her/their purchased Raffle Ticket(s). Entries which are or appear to have been tampered with are void. Cincinnati Opera shall be the sole judge of the validity and eligibility of all entries. All Raffle Ticket purchases shall be final. And no refunds or replacements will be issued by Cincinnati Opera. Raffle Tickets are only valid for the drawing held on June 25th, 2022.
  7. Raffle Tickets are Not Tax Deductible. Under IRS guidelines amounts paid for chances to participate in raffles, lotteries, or similar programs are not gifts and, therefore, the price of the entry does not qualify as a deductible charitable contribution to Cincinnati Opera.
  8. Each winner shall be responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with a prize. At the time of this printing, federal law requires that a tax withholding on certain prize values must be collected from winners upon award and distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time each prize is claimed will be followed. The winner will receive a W-2G form from Cincinnati Opera. Taxes will incur in accordance with IRS and State of Ohio Guidelines.
  9. Selection of Winner. One (1) Raffle Ticket will be drawn by Cincinnati Opera to determine the winner of the Viking River Cruise Prize. The drawing will be held on June 25th, 2022. The drawing will be conducted by Cincinnati Opera during The Toast, the continuation “after-party” of the Bal de Triomphe. The number of the winning Raffle Ticket will be announced directly following the drawing, at The Toast. It will also be announced on Cincinnati Opera’s website and through other media at the discretion of Cincinnati Opera. The winner need not be present at the time of the drawing. If the winner is not present, a staged photo will be requested at a later date.
  10. Prize Claim. Within thirty (30) days of the applicable drawing, the prize claimant must notify Cincinnati Opera and present the winning Raffle Ticket, or provide the Raffle Ticket number and a valid ID, to claim the prize associated with that Raffle Ticket. Prize claimants must provide Cincinnati Opera with all information required to claim the prize (including tax identification information). The Prize claimant will receive an AFFIDAVIT OF ELIGIBILITY & LIABILITY/PUBLICITY RELEASE (“Release”) which must be executed and returned to Cincinnati Opera no later than five (5) business days after his/her/their receipt of the Release. In the event a claimant: (a) does not notify Cincinnati Opera within thirty (30) days of the drawing; (b) is ruled ineligible for any reason; (c) refuses the prize; or (d) does not return an executed Release, the prize will be forfeited and will be retained by Cincinnati Opera for charitable use. Cincinnati Opera may attempt to contact potential prize winners, but has no obligation to contact potential prize winners. The Prize claimant will receive a certificate that can be presented to Viking Cruises for claim of prize. No cash payment(s) will be made to the winner.
  11. Odds. The odds of winning the Raffle depend on the number of Raffle Tickets purchased for the drawing. With 150 Raffle Tickets for sale, if all Raffle Tickets sell the odds will be 1:150, or approximately 0.66%.
  12. Transfer of Raffle Ticket or Prize. Persons who purchase a Raffle ticket may opt to give away their Raffle Ticket to other eligible persons, but in doing so the purchaser waives any claim he/she/they might otherwise have to the prize. Purchasers of Raffle Tickets may not re-sell their Raffle Tickets to other parties, and may not knowingly give Raffle Tickets away to others for the purpose of allowing those other parties to re-sell such Raffle Tickets. All Raffle Tickets which have been resold in violation of these Official Rules shall be void. All individuals who re-sell, purchase, or receive Raffle Tickets in violation of these Official Rules shall be ineligible to participate in the Raffle or to win the prize. A winner may transfer his/her/their prize to a third party provided that the following conditions are met: (a) the transferee would have otherwise been ineligible to enter the Raffle (age eighteen (18) or older); (b) the transferee shall be responsible for all taxes and costs described by these Official Rules; and (c) the transferee shall be bound by all terms and conditions of these Official Rules that are applicable to the winner.
  13. The Raffle will be conducted and supervised by Cincinnati Opera whose decisions are final. Cincinnati Opera reserves the right, in its own discretion, to cancel or suspend the Raffle should unauthorized human intervention or other causes corrupt the administration, security, fairness, integrity, or proper operation of the Raffle.
  14. Release of Liability. By entering into the Raffle, all entrants agree to: (a) be bound by these Official Rules; and (b) release Cincinnati Opera together with its members, employees, officers, directors, sponsors, representatives, and agents from any and all liability with respect to any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from participation in the Raffle, or from any travel or activity related to the receipt or use of any prize.
  15. Publicity Release. The winner, by accepting the prize, grants Cincinnati Opera and its designees and affiliates, full permission, except where legally prohibited, to use such winner’s name, address (city and state only), photograph, voice and/or other likeness, and prize information for advertising, trade and promotional purposes without further compensation and without notice, review or approval, in all media now known or hereafter discovered, worldwide and in perpetuity. Each winner shall execute all documents that Cincinnati may require to be signed in connection with this release.
  16. Winning Number. Once drawn, the winning number can be obtained by sending a request to Cincinnati Opera at nrader@cincinnatiopera.org.
  17. Governing Law. The Raffle and these Official Rules shall be subject to and governed by the laws of the State of Ohio. If a court of competent jurisdiction finds that any provision of these Official Rules, or their application to a particular persons or circumstances, is invalid or unenforceable to any extent, then the remainder of these Official Rules shall remain enforceable to the fullest extent permitted by law. The sole jurisdiction and venue for any cause of action arising out of the Raffle or these Official Rules shall be the courts located in Hamilton County, Ohio.
